What is The National Center for Interstate Compacts?
Modern compacts are a reinvigoration of our federalist system in which states may only be able to preserve their sovereign authority over interstate problems to the extent that they share their sovereignty and work together cooperatively through interstate compacts.
Today, states are facing issues that are not confined to geographical boundaries or jurisdictional lines. As we become more integrated socially, culturally and economically, the volume of these issues will only increase, making federal pre-emption in certain policy areas an ever more likely response. Interstate compacts may well prove to be an apt mechanism for developing state-based solutions to supra-state problems while preserving the states' authority and freedoms.
The National Center for Interstate Compacts (NCIC) is designed to be an information clearinghouse, a provider of training and technical assistance and a primary facilitator in assisting states review, revise and create new interstate compacts to solve multi-state problems or provide alternatives to federal pre-emption. As such, the NCIC will combine policy research and best practices, and function as a membership association, serving the needs of compact administrators, compact commissions and state agencies where interstate compacts are in effect.
The Council of State Governments is uniquely positioned to offer a full range of services to states that are in need of not only information and expertise, but also guidance and technical assistance in dealing with interstate compacts and other interstate agreements. Throughout its 70-year history, CSG has been at the forefront of promoting multi-state problem solving and advocating the role of the states in determining their respective futures. CSG has played an integral role in the development of numerous interstate compacts, tracking the progress of more than 200 active interstate compacts, researching innovative solutions for the states and bringing the states together to build consensus on national issues.

Since its founding, CSG has played an integral role in the development, revision and tracking of interstate compacts. CSG is actively involved in several interstate compact initiatives, including:
Interstate Compact on Educational Opportunity for Military Children
Military Families move between posts on a regular basis. While reassignments can often be a boon for career personnel, they can present challenges to the children of military families; losing and making new friends, adjusting to new cities and bases, and changing schools. According to the Military Education Coalition, the average military student changes schools more than twice during high school and most military children will be in six to nine different school systems in their lives, from Kindergarten to 12th grade. The Council of State Governments (CSG), in cooperation with the U.S. Department of Defense Office of Personnel and Readiness, is assembling a national Advisory Group to examine the creation of a new interstate agreement impacting the children of military families.
Interstate Compact for Juveniles
Interstate Compact on Educational Opportunity FOR Military Children VideoThe Council of State Governments, in cooperation with the Office of Juvenile Justice and Delinquency Prevention, is currently supervising the introduction of the Interstate Compact for Juveniles. At issue are the management, monitoring, supervision and return of juveniles, delinquents and status offenders who are on probation or parole and who have absconded, escaped or run away from supervision and control to states other than where they were sentenced. CSG is committed to ensuring that the compact remains an effective management tool for those juveniles who travel to, or are supervised in, states other than where they were sentenced or reside.
Interstate Compact for the Placement of Children
The Council of State Governments, in cooperation with the American Public Human Services Association, has drafted a revision to the Interstate Compact for the Placement of Children. Currently enacted by all 50 states, the District of Columbia and the U.S Virgin Islands, the compact is in need of a massive overhaul to repair its outdated construction and enhance its effectiveness in ensuring that interstate placements are made in a timely and effective manner. The new compact has been enacted in Ohio (June 2006) and is available to all states for consideration.
Great Lakes - St. Lawrence River Basin Water Resources Compact
Since 2001, the Council of Great Lakes Governors (CGLG) has worked to develop a framework of binding agreements among the Great Lakes states and Canadian provinces for managing the Great Lakes resource. The culmination of this effort is the new Great Lakes – St. Lawrence River Basin Water Resources Compact. The agreement details how states and provinces will manage and protect the Great Lakes and St. Lawrence River Basin.
Interstate Compact for Adult Offender Supervision
The Council of State Governments led the effort to revise the failing interstate compact, originally conceived in 1937. In collaboration with the National Institute of Corrections, CSG has helped 50 states, the District of Columbia, Puerto Rico and the U.S. Virgin Islands adopt the compact over the last four years and now serves as a secretariat to the Interstate Commission for Adult Offender Supervision. This revised compact serves as a cutting-edge model of what the modern compact mechanism can accomplish - a streamlined, efficient and accountable interstate agreement that applies to a wide range of policy issues.
Emergency Management Assistance Compact (EMAC)
Administered by CSG's affiliate organization, the National Emergency Management Association (NEMA), EMAC is a mutual aid agreement and partnership between states that exists because, from hurricanes to earthquakes and from wildfires to toxic waste spills, all states share a common enemy: the constant threat of disaster. EMAC offers a quick and easy way for states to send personnel and equipment to help disaster relief efforts in other states. Requests for EMAC assistance are legally binding, contractual arrangements which make states that ask for help responsible for reimbursing all out-of-state costs and liable for out-of-state personnel. EMAC allows states to ask for whatever assistance they need for any emergency, from earthquakes to acts of terrorism. On the other hand, states are not forced to send any assistance unless they are able to. EMAC's simple procedures also mean states can dispense with bureaucratic wrangling.
Midwest Interstate Passenger Rail Compact
Administered from CSG's Midwest Office, the Midwest Interstate Passenger Rail Compact brings together state leaders from across the region to advocate for passenger rail improvements. Formed by compact agreement in 2000, the compact's current members are Illinois, Indiana, Iowa, Michigan, Minnesota, Missouri, Nebraska, North Dakota, Ohio and Wisconsin. The main purposes of the compact are to promote, coordinate and support regional improvements to passenger rail service: 1) Promote development and implementation of improvements and long-range plans for intercity passenger rail service in the Midwest; 2) Coordinate interaction among Midwestern state officials, and among the public and private sector at all levels (federal, state and local); and 3) Support current state efforts conducted through state DOTs.

Summit of the States on Interstate Cooperation
June 1-2, 2006
The Council of State Governments (CSG) hosted the first ever Summit of States on Interstate Cooperation June 1-2, 2006 at the Westin Hotel in Cincinnati. The summit convened with 90 high-ranking state officials from around the country, representing more than 30 states and jurisdictions.
Hosted by former CSG Chair and Ohio State Sen. Stan Aronoff, the two-day summit continued CSG’s tradition of bridging policy gaps between the states and facilitating the development of interstate solutions to increasingly interdependent issues. An outgrowth of CSG’s National Center for Interstate Compacts, the summit was a watershed event promoting the tenets of interstate agreements and gathering together key stakeholders from around the country to discuss the future of interstate cooperation.
In addition, the two-day program was approved for Continuing Legal Education credits (CLE) by Indiana (7.0 hours), Kentucky (7.0 hours) and Ohio (9.75 hours). Background
Military families move between postings on a regular basis. While reassignments can often be a boon for career personnel, they often wreak havoc on the children of military families. Issues these children face include: losing and making new friends, adjusting to new cities and bases, and changing schools. While the armed services have taken great leaps to ease the transition of personnel, their spouses and most importantly children, much remains to be done at the state and local levels to ensure that the children of military families are afforded the same opportunities for educational success as other children and are not penalized or delayed in achieving their educational goals by inflexible administrative and bureaucratic practices.
The average military student faces transition challenges more than twice during high school, and most military children will have six to nine different school systems in their lives from kindergarten to 12th grade. With more than half of all military personnel supporting families, the impacts of reassignment and long deployments are key considerations when making long-term life choices.

Project Overview
The Great Lakes are the world's single largest source of fresh surface water. Although seemingly abundant, fresh water is still relatively limited in quantity and is highly vulnerable to contamination. State and federal policymakers historically have not developed adequate conservation strategies to ensure the best management practices are in place to effectively shield the Great Lakes from significant degradation. The protection and restoration of the Great Lakes system is instrumental to the region's economy, environment and overall quality of life.
Since 2001, the Council of Great Lakes Governors (CGLG) has worked to develop a framework of binding agreements among the Great Lakes states and Canadian provinces for managing the Great Lakes water resources. The culmination of this effort is the new Great Lakes-St. Lawrence River Basin Water Resources Compact. The agreement details how states and provinces will manage and protect the Great Lakes and St. Lawrence River Basin, including:
- Banning new diversions of water from the Basin; limited exceptions could be allowed, such as for public water supply purposes, but would be strictly regulated;
- Enforcing a consistent standard to review proposed uses of Great Lakes water;
- Collecting and sharing technical data on the use of Great Lakes water, and promoting the sharing of information among Great Lakes states and provinces;
- Developing regional goals for water conservation and efficiency and promoting water conservation and efficiency programs in the states and provinces;
- Promoting lasting economic development balanced with sustainable water use; and
- Recognizing the Great Lakes basin as a shared public treasure and committing to continued public involvement in implementing policies.

The Interstate Compact for the Placement of Children, as currently written and implemented, is not an effective mechanism for the states to ensure that children placed across state lines for purposes of foster care or adoption are placed with safe, suitable parents that can provide proper care and to ensure that necessary services and supports are in place.
First drafted in the 1950s and currently enacted by all 50 states, the District of Columbia and the U.S. Virgin Islands, the compact is in need of a massive overhaul to repair its outdated construction and enhance its effectiveness in ensuring that interstate placements are made in a timely and effective manner.
Language within the compact is outdated, governing structures established by the compact are antiquated and basic management and administration issues of the compact are either obsolete or omitted completely from the existing language. Its application has become "overly broad," and the underlying assumption regarding the cost of the provision of home studies and supervision would be one of quid pro quo is no longer accurate.
Goal of the Project
The revised compact is based on recommendations already made to APHSA by its members, observations made by the stakeholder organizations represented on the developing and drafting team as well as a select group of additional outside stakeholders, and compact expertise and advice from The Council of State Governments and other needed consultants. Once a new compact is approved, introduction and passage by state legislators, and implementation of the revised compact by all 50 states, the District of Columbia and the United States territories is the goal.

IMPORTANT UPDATE

The Council of State Governments, in cooperation with the Office of Juvenile Justice and Delinquency Prevention, is currently supervising the introduction of The Interstate Compact for Juveniles. At issue are the management, monitoring, supervision and return of juveniles, delinquents and status offenders who are on probation or parole and who have absconded, escaped or run away from supervision and control to states other than where they were sentenced. Also at issue is the safe return of juveniles who have run away from home, leaving their state of residence.

The Interstate Compact for Juveniles, a new interstate agreement, significantly updates the 50-year-old mechanism for tracking and supervising juveniles that move across state borders. Providing enhanced accountability, enforcement, visibility and communication, the new compact seeks to update a crucial, yet outdated tool for ensuring public safety and preserving child welfare.
Primary changes to the original Juvenile Compact (1955) include:
- The establishment of an independent compact operating authority to administer ongoing compact activity, including a provision for staff support.
- Gubernatorial appointments of representatives for all member states on a national governing commission. The commission would meet annually to elect the compact operating authority members, and to attend to general business and rule making procedures.
- Rule-making authority, provision for significant sanctions to support essential compact operations.
- Mandatory funding mechanism sufficient to support essential compact operations (staffing, data collection, training/education, etc.).
- Compel collection of standardized information.
