Supreme Court Rules States may be Sued under USERRA

In Torres v. Texas Department of Public Safety the U.S. Supreme Court held 5-4 that Congress’s war powers allow it to subject non-consenting states to money damages lawsuits under the Uniformed Services Employment and Reemployment Rights Act (USERRA).

Supreme Court to Decide whether and how Texas and Texas Officials May be Sued over Abortion Law

On November 1st the U.S. Supreme Court will hear oral argument in two cases challenging Texas’s abortion law. S.B. 8, enacted earlier this year, prohibits abortions in Texas after approximately six weeks.

States’ Rights Lose at SCOTUS

In PennEast Pipeline v. New Jersey the U.S. Supreme Court held 5-4 that the federal government may constitutionally grant pipeline companies the authority to condemn necessary rights-of-way in which a state has an interest.
